Food item thrown by protester reportedly exploded and caused yellow spot on border agent, legal proceedings reveal
A federal customs official has stated under oath he could sense through his ballistic vest the force of a deli item thrown at him by a DC demonstrator, who has faced court proceedings for assault.
Customs and Border Patrol agent the government official testified to the legal jury the sandwich "exploded all over him" and he "noticed the vegetables and yellow sauce" on his official attire.
Both legal teams challenges that Sean Dunn, 37, did in fact throw vulgar language and a prepared food item at law enforcement sent by President Donald Trump to secure the Washington DC in late summer.
The incident was captured on camera and became popular online, making the defendant a symbol of opposition in the federal district to the administration.
Government prosecutors originally tried to obtain felony charges against the defendant, but a judicial committee refused to prosecute him.
The administration's deployment of military personnel to Washington DC this summer caused anger from some of the local inhabitants, who saw it as a politicisation of the troops.
According to legal filings, the defendant walked up to a group of officers at about late evening on August 10, calling them "fascists" and exclaiming: "What is your purpose? Your presence is unwanted in my city!"
The court observed a demonstration from the agent on Tuesday as he testified against the defendant.
"I could feel it through my body armor," he said of the food's collision, adding that an vegetable piece dangled from his official equipment and condiment marked his clothing.
The accused's legal counsel, his legal representative, said in her court presentation that launching the deli product was a "innocent action that did not, could not, create physical damage".
But prosecutor the state's representative argued Mr Dunn must be facing consequences.
"No matter who you are, you cannot simply launching items at others because you're upset," the attorney stated.
Subsequent to the reported incident came to light, the accused was dismissed from his job as a paralegal in the government law department.
